These Terms of Service ("Terms") govern your access to and use of the Custom Heroes website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Service Description

Custom Heroes is a service for making personalized children's picture books with the help of AI. Here's how it works:

• You tell us your story idea, and confirm the people, pets, and things in it
• We write the story with AI. You can edit any page or ask for a rewrite
• You pick an art style and upload photos, and we draw your characters with AI
• Before you pay, you see your cover, a fully illustrated first spread, and every page's words
• After you order, we illustrate every page. You can redraw pages and the cover, then give the book a final look and send it to print (or finish it, for a digital book)

Every book has 16 illustrated story pages. A printed book has 32 pages, including a dedication page and a free "Color the story" section of coloring pages made from your book's pictures. The digital PDF has the story and keepsake pages, without the coloring section.

Each book starts fresh: characters and photos aren't carried over from one book to the next. Once a book's cover or a page has been illustrated, its art style can't be changed.

3. Account Registration

To use our services, you must create an account. You are responsible for:

• Being at least 18 years old
• Providing accurate and complete information, including the country you live in, which decides whether you can order a printed book
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Payment and Pricing

Making and previewing a book is free. You pay when you order, and prices are per edition:

Printed Books (US addresses only):

• Softcover: $44.99, standard US shipping included
• Hardcover: $59.99, standard US shipping included

Outside the US:

• Digital PDF only (no printed book): $19.99

Every printed book includes the digital PDF, which you can download once you've sent your book to print. Extra printed copies of a finished book can be ordered at the same price.

All payments are processed securely through Stripe. Because every book is made just for you, orders can't be refunded once we start illustrating, except as described in our Refund Policy. Prices may change, but never for an order you've already placed.

To keep the service running fairly, there are generous limits on how much AI work (redraws, rewrites, and books started) one account can use. If you reach one, we'll tell you what you can do next.

5. User Content and License

When you upload photos or tell us your story idea:

• You retain ownership of your original content
• You grant us a license to use, process, and modify your content only to make, print, and deliver your book, including sharing it with the companies that help us do that, as described in our Privacy Policy
• You represent that you have all necessary rights to the content
• You confirm that content doesn't infringe on third-party rights
• You have permission to use the photos and details of everyone in your book. For a child who isn't yours, that means their parent or guardian's permission

We reserve the right to refuse or remove content that violates these Terms, is inappropriate, or that we find objectionable.

6. AI-Generated Content

Your story and pictures are made with AI from Anthropic (the story) and OpenAI (the pictures). Please understand that:

• AI can make mistakes or produce unexpected results, like a misspelled word in a picture or a detail that changes between pages
• You can edit the story, redraw your characters and cover, and see your first spread before you order, and redraw any page before you send your book to print
• Please read your whole book before you send it to print: we print it exactly as you approved it
• We don't guarantee a particular result from the AI
• We and our AI providers may decline to make content that isn't suitable for a children's book

7. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Custom Heroes or our licensors and is protected by intellectual property laws.

The personalized books you create are for personal, non-commercial use. You may not reproduce, distribute, or sell the books without our written permission, except for personal gifts or family use.

8. Acceptable Use

You agree not to:

• Use our service for any illegal or unauthorized purpose
• Upload content that is offensive, harmful, or inappropriate for children
• Upload photos of people without the permission described in section 5
• Attempt to bypass any security measures or usage limits
• Interfere with or disrupt our services
• Use automated systems to access our service without permission
• Resell or commercially exploit our service without authorization

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for third-party services or content

10. Indemnification

You agree to indemnify and hold Custom Heroes, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease. You may also terminate your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

13. Printed Books and Shipping

Every printed book is shipped to your US address, with standard shipping included:

• Production: Books are printed by our printing partner, Lulu, after you send your finished book to print
• Timeline: Printing and delivery take 5-10 business days after you send your book to print
• Shipping: We are responsible for safe delivery to the provided address
• Damage: We reprint damaged or misprinted books free of charge if you tell us within 7 days of delivery
• Lost Packages: We will reship lost packages at no additional cost
• International: Currently limited to US addresses only

Important:Books are custom-made products and can't be returned. A misprint means the printed book doesn't match what you approved, so please read your book carefully before you send it to print. See our Refund Policy for details.

You are responsible for providing accurate shipping information. We are not liable for delays or non-delivery due to incorrect addresses or force majeure events.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
